High school

Who sets the rules

DIAA (Delaware Interscholastic Athletic Association)

The rule

14 DE Admin. Code 1030 sec. 3.4 (NIL amendment adopted by DIAA board April 2024, final rule 28 DE Reg 294, effective ~Oct 11, 2024): a student may earn NIL compensation if not tied to performance, not an enrollment incentive, and not provided by the school or its agent.

Tell the school

72 hours, agent contracts only

Only agency contracts: student must inform the member school's athletic director within 72 hours of signing or before the next scheduled athletic event, whichever first (3.4.5, cross-referencing 24 Del. C. 5409). No deadline for ordinary NIL deals.

Off limits

No member-school or DIAA logos, names, mascots or acronyms; no school apparel/equipment bearing marks; no member-school facilities; no tobacco, alcohol or gambling endorsements.

Agents

Allowed

Agency contracts contemplated; agent must be registered under Delaware RUAAA, parent/guardian must sign for a minor, 14-day cancellation right.

If a rule is broken

Regulation does not state an NIL-specific penalty; general forfeiture of amateur status makes the student ineligible in that sport with reinstatement possible after suspension of up to the number of school days in a year.

Middle school, club and travel ball

Regulation 1030 sec. 1.0 governs eligibility at middle and high school levels, so the NIL rule reaches DIAA middle school athletes. Club play not addressed. The state athlete-agent law (24 Del. C. ch. 54) independently covers interscholastic (K-12) athletes.

Recent changes

NIL permission adopted 2024; no 2025-2026 change found.

College state law

Narrow law

The law

24 Del. C. ch. 54, Delaware Revised Uniform Athlete Agents Act (SB 297, signed Nov 22, 2022, eff. July 1, 2023); defines NIL agreements/compensation and folds them into 'agency contract'. No standalone NIL statute.

Disclosure

No general NIL-deal disclosure. Agent and athlete must each notify the athletic director within 72 hours of an agency contract or before next event (5410(b)-(c)).

Schools paying athletes

Not addressed.

For high school recruits

Yes: 'student athlete' includes anyone eligible for interscholastic sports and 'educational institution' includes elementary and secondary schools (5402); minors' agency contracts require parent/guardian signature and may be voided by the parent (5409(e),(g); 5411).

Recent changes

None found 2025-2026. (athleteagent.ai lists 'HB 199 (2021)' as a Delaware NIL law.

NCAA Division I, everywhere

Every deal worth $600 or more (added up per payer) entered since July 1, 2025 or the start of junior year, whichever is later, must be reported through NIL Go within 14 days of starting classes or before the first game.

Recruits enrolling on or after August 1, 2026 may hire agents under the April 15, 2026 Division I rule. The NJCAA still ends eligibility for a written agent agreement.

Quick answers

Can high school athletes in Delaware make NIL money?

Yes. High school athletes in Delaware can take NIL deals, with conditions.

Do Delaware athletes have to tell the school about an NIL deal?

72 hours, agent contracts only. Only agency contracts: student must inform the member school's athletic director within 72 hours of signing or before the next scheduled athletic event, whichever first (3.4.5, cross-referencing 24 Del. C. 5409). No deadline for ordinary NIL deals.

Does a travel ball or club deal count in Delaware?

State association rules follow the athlete, not where the deal came from. A deal through a travel team is fine as long as nothing ties back to the school team. C. ch. 54) independently covers interscholastic (K-12) athletes.

Can a Delaware high school athlete use an agent for NIL?

Allowed. Agency contracts contemplated; agent must be registered under Delaware RUAAA, parent/guardian must sign for a minor, 14-day cancellation right.
