High school NIL, 50 states plus D.C.

The map

High school rules come from each state's athletic association, and sometimes a state law on top. College rules come from state law plus the NCAA. Switch between them.

The rule almost every state shares

Keep the school out of it.

Nearly every penalty case so far started with a kid posting in a school jersey, not with the money itself. Wherever NIL is allowed, these stay off the content:

  • School name or team name
  • School logos and mascots
  • School uniforms and warmups
  • School facilities and equipment
  • Game film the school owns
  • Hashtags or tags of the school team

What travel families get wrong

01

A travel ball deal still counts.

State association rules follow the athlete, not where the deal came from. A deal set up through a travel team is fine where NIL is allowed, as long as nothing ties back to the school team. Where NIL is banned, it can still cost school eligibility.

02

Free gear is NIL.

There's no bright line between free product and pay. A post about free cleats is an endorsement under FTC rules and needs a clear "ad" or "sponsored" label. Identical gear for the whole roster is the safe pattern.

03

It's taxable from the first dollar.

Including gear and gift cards. Most NIL work is self-employment income, brands only send a 1099-NEC at $2,000 or more for 2026, and high school income shows up on the FAFSA two years later.

What changed

The biggest moves since most NIL guides were written. If your source is older than 2026, check these first.

  1. South Carolina

Now a total ban by statute. Act 187 of 2026 requires the SCHSL to prohibit student NIL. A violation means a warning, then one year ineligible.

  2. Louisiana

Allowed by statute since August 1, 2026. Parental consent under 18, disclosure before signing, and NIL agents must register with the Attorney General.

  3. Wyoming

The ban became state law July 1, 2026, after the WHSAA's own NIL proposal failed.

  4. Ohio

Allowed since November 2025. Agents allowed since May 2026. Every deal goes to the OHSAA within 14 days with a notarized affirmation.

  5. Michigan

Rewritten January 23, 2026. Broad permission, but no deals with collectives or boosters, and disclosure within 7 business days.

  6. Indiana

New for 2026-27. Tell the athletic director within 48 hours. Older guides still say Indiana bans NIL.

  7. Missouri

The association allows NIL, but state law says only after signing with a Missouri college. Families need to know both.

  8. Florida

No deals in the season a student transfers. Political or social activism is now a banned category.
