High school

Who sets the rules

Georgia High School Association (GHSA)

The rule

GHSA By-law 1.97 says students may receive consideration for their own NIL, with guidance in Appendix N. NIL does not jeopardize amateur status if compensation is not tied to athletic performance, not an inducement to enroll or stay, and not provided by the school or anyone acting for it, and no recruiting/undue-influence (1.70) violation occurs. Adopted Oct. 2, 2023; collectives amendment added July 2024.

Tell the school

7 calendar days, to the principal or AD

Within seven calendar days of entering any NIL contract/agreement the student or parent/guardian must notify the school's principal or athletic director. No dollar threshold or state form.

Off limits

No school or GHSA marks: logos, school name, uniforms, mascot, trademarked GHSA logos/acronyms; no school apparel or equipment worn; no member school facility used; no endorsing anything that conflicts with local district policy (examples: tobacco, alcohol, controlled substances); no membership in or benefit from a Collective or NIL Club (booster clubs supervised by the school and funding team-level needs are exempt); compensation may not come from the school or its agent; NIL may not violate recruiting/undue influence by-law 1.70. Families told to get professional advice on financial aid and tax impact.

Agents

Not addressed

For NIL-only advisors; By-law 1.92(d) still says hiring an agent to manage the athletic career forfeits amateur status in that sport.

If a rule is broken

Loss of eligibility to compete in GHSA activities (collectives amendment); amateur-status violations under 1.92 forfeit amateur status in that sport. Schools that knowingly allow violations face fines, forfeits, probation, and postseason ineligibility.

Middle school, club and travel ball

Appendix N and 1.92 apply to GHSA member-school student-athletes. GHSA does not govern middle school play except eighth graders playing up on a high school team, who must meet member-school rules. No reach into club or travel play.

Recent changes

None in 2025-26 or 2026-27. The 2026-27 Constitution (Vol. 120 No. 1) carries the same Appendix N text as 2025-26 (last substantive change was the July 2024 collectives/NIL Club amendment). HB 383 (2025), the Georgia High School NIL Protection Act that would have put HS NIL rights in statute, was recommitted to committee April 4, 2025 and did not pass.

College state law

Repealed

The law

Former O.C.G.A. 20-3-680 through 20-3-683 (2021 Ga. Laws 228, HB 617, eff. July 1, 2021)

Disclosure

None currently. The former 20-3-681 disclosure provisions ended with the article.

Schools paying athletes

No state statute; governed by NCAA rules and the House settlement.

For high school recruits

None in force. HB 383 (2025-26), a High School NIL Protection Act covering 'high school student athletes and prospective student athletes' and allowing professional representation, stalled in the House (recommitted April 4, 2025).

Recent changes

The 2025 Code of Georgia lists 20-3-680 to 20-3-683 as [Repealed] with an editor's note that the article was rendered null under 20-3-683 once the NCAA adopted its interim NIL policy effective July 1, 2021. 20-3-683 also set an outside termination date of June 30, 2025. No 2025 or 2026 legislative act repealed or replaced it.

NCAA Division I, everywhere

Every deal worth $600 or more (added up per payer) entered since July 1, 2025 or the start of junior year, whichever is later, must be reported through NIL Go within 14 days of starting classes or before the first game.

Recruits enrolling on or after August 1, 2026 may hire agents under the April 15, 2026 Division I rule. The NJCAA still ends eligibility for a written agent agreement.

Quick answers

Can high school athletes in Georgia make NIL money?

Yes. High school athletes in Georgia can take NIL deals, with conditions.

Do Georgia athletes have to tell the school about an NIL deal?

7 calendar days, to the principal or AD. Within seven calendar days of entering any NIL contract/agreement the student or parent/guardian must notify the school's principal or athletic director. No dollar threshold or state form.

Does a travel ball or club deal count in Georgia?

State association rules follow the athlete, not where the deal came from. A deal through a travel team is fine as long as nothing ties back to the school team. Appendix N and 1.92 apply to GHSA member-school student-athletes. GHSA does not govern middle school play except eighth graders playing up on a high school team, who must meet member-school rules. No reach into club or travel play.

Can a Georgia high school athlete use an agent for NIL?

Not addressed. For NIL-only advisors; By-law 1.92(d) still says hiring an agent to manage the athletic career forfeits amateur status in that sport.
