Who sets the rules

Idaho High School Activities Association (IHSAA; website idhsaa.org)

The rule

IHSAA Rule 8-4-1(a): an athlete forfeits amateur status in a sport by capitalizing on athletic fame through money, compensation, endorsements or gifts 'in affiliation or connection with the student's school team, school, league, district or IHSAA'; sub-rule 8-4-1(a)(1) says this is not intended to restrict a student's right to do a commercial endorsement provided there is no school team, school, league, district or IHSAA affiliation. NIL is not separately defined. In place since the 2022-23 rules.

Tell the school

None statewide

None. No notification, form or deadline in the rule.

Off limits

Only restriction is no affiliation with the school team, school, league, district or IHSAA in the endorsement. No product-category list, no collectives language, no parent-signature requirement, no NIL-specific recruiting clause (general recruiting/undue influence rules apply separately). Accepting a nominal fee for instructing or officiating youth sports is permitted (8-4-2).

Agents

If a rule is broken

Forfeits amateur status in that sport (sport-specific); 8-4-4 lets a student apply to the Association for reinstatement.

Middle school, club and travel ball

Rule 8 governs students representing an IHSAA member school in interscholastic sports; the IHSAA does not govern middle school or non-school club play.

Recent changes

None found for 2025-26 or 2026-27; the 2026-27 Rules and Regulations carry identical 8-4 text.

College state law

No state law

The law

None. Athlete-agent law: Idaho Code Title 54, Chapter 48 (Revised Uniform Athlete Agents Act, 54-4801 et seq.)

Disclosure

None in statute.

Schools paying athletes

Not addressed by statute.

For high school recruits

None.

Recent changes

No NIL statute enacted. 2026 Senate Joint Memorial 114 (adopted April 1, 2026) urges Congress to create a uniform national NIL/revenue-sharing framework; it is a memorial, not law.

NCAA Division I, everywhere

Every deal worth $600 or more (added up per payer) entered since July 1, 2025 or the start of junior year, whichever is later, must be reported through NIL Go within 14 days of starting classes or before the first game.

Recruits enrolling on or after August 1, 2026 may hire agents under the April 15, 2026 Division I rule. The NJCAA still ends eligibility for a written agent agreement.

Quick answers

Can high school athletes in Idaho make NIL money?

Yes. High school athletes in Idaho can take NIL deals, with conditions.

Do Idaho athletes have to tell the school about an NIL deal?

None statewide. None. No notification, form or deadline in the rule.

Does a travel ball or club deal count in Idaho?

State association rules follow the athlete, not where the deal came from. A deal through a travel team is fine as long as nothing ties back to the school team. Rule 8 governs students representing an IHSAA member school in interscholastic sports; the IHSAA does not govern middle school or non-school club play.

Can a Idaho high school athlete use an agent for NIL?

Not addressed.
