High school

Who sets the rules

NSAA (Nebraska School Activities Association)

The rule

NSAA Bylaw 3.7.1.c Approved Ruling on NIL, effective Feb. 27, 2023, lets students engage in NIL activity provided no school uniform/gear, facilities, equipment or game/practice film is used, no promotion during the school day or team activities, and no sponsor logo where school uniform/dress rules apply.

Tell the school

None statewide

None required; the NSAA states it will not review NIL contracts. The only requirement is that the student or parents know the student's name/picture is being used.

Off limits

No school uniforms/gear/facilities/film; no promotion during school day or team activities; may not promote alcohol, tobacco, nicotine, vaping, controlled substances including cannabis and paraphernalia, anything unlawful for school-aged students, or gambling of any kind (including licensed sports betting). School-affiliated parties (booster clubs, foundations, employees, anyone affiliated with the school) may not provide NIL compensation to induce a student to attend or participate (collectives not named but covered).

Agents

Not addressed

If a rule is broken

A violation 'may result in a determination by the member school and the NSAA' that the student is ineligible for activity participation.

Middle school, club and travel ball

NSAA governs member-school activities; nothing in the ruling addresses middle school or non-school club play. Compliance with the NSAA ruling does not ensure NCAA/NAIA/NJCAA compliance.

Recent changes

None found since 2023 (the ruling is the current NSAA yearbook document; the Board may revise it).

College state law

Law in force

The law

Neb. Rev. Stat. §§ 48-3601 to 48-3609, Nebraska Student-Athlete Name, Image, or Likeness Rights Act (LB 962, 2020; amended LB 1137, 2022; LB 1393, 2024, approved April 16, 2024 with emergency clause). Citation OK.

Disclosure

§ 48-3604 requires an athlete who signs an NIL/athletic-reputation compensation contract to disclose it to an official designated in writing by the institution; the institution may not disclose terms the athlete deems trade secrets.

Schools paying athletes

LB 1393 (2024) lets institutions create, facilitate or support NIL activities and pay athletes directly when a collegiate athletic association policy and institutional policy, a court order, or a settlement agreement allows it; NIL pay does not make the athlete an employee.

For high school recruits

None. Applies only to athletes participating in intercollegiate sports at a postsecondary institution.

Recent changes

LB 370 (2025, Sen. Hunt) would have further amended the Act (direct pay, agent standards, limits on association reporting rules); it was held in committee and indefinitely postponed April 17, 2026. No change to the statute since 2024.

NCAA Division I, everywhere

Every deal worth $600 or more (added up per payer) entered since July 1, 2025 or the start of junior year, whichever is later, must be reported through NIL Go within 14 days of starting classes or before the first game.

Recruits enrolling on or after August 1, 2026 may hire agents under the April 15, 2026 Division I rule. The NJCAA still ends eligibility for a written agent agreement.

Quick answers

Can high school athletes in Nebraska make NIL money?

Yes. High school athletes in Nebraska can take NIL deals, with conditions.

Do Nebraska athletes have to tell the school about an NIL deal?

None statewide. None required; the NSAA states it will not review NIL contracts. The only requirement is that the student or parents know the student's name/picture is being used.

Does a travel ball or club deal count in Nebraska?

State association rules follow the athlete, not where the deal came from. A deal through a travel team is fine as long as nothing ties back to the school team. NSAA governs member-school activities; nothing in the ruling addresses middle school or non-school club play. Compliance with the NSAA ruling does not ensure NCAA/NAIA/NJCAA compliance.

Can a Nebraska high school athlete use an agent for NIL?

Not addressed.
