Who sets the rules

North Dakota High School Activities Association (NDHSAA)

The rule

NDHSAA By-Laws Part II, Article VIII (Amateurism) carry a June 2022 interpretation: 'A student may benefit from the use of their name, image and likeness (NIL) consistent with current NDHSAA regulations.' The board-approved NIL regulations (June 7, 2022) are not reproduced in the handbook and are not posted publicly; the operative conditions are known only from NDHSAA statements to the press.

Tell the school

None statewide

No NIL-specific disclosure requirement found in the 2025-26 Constitution/By-Laws. (Article IX awards rule separately requires coaches to report award compensation to the AD within one month; that is an awards rule, not an NIL rule.)

Off limits

Per NDHSAA statements (June 2022): no school uniforms, school or league logos in marketing; booster clubs may not be involved; NIL may not be used to recruit/influence school choice; no pay for athletic performance.

Agents

Not addressed

If a rule is broken

No NIL-specific penalty in the handbook; general amateurism penalty is loss of amateur standing with reinstatement possible after one calendar year (Art. VIII Sec. V); schools permitting ineligible participation may be suspended for at least a year (Art. VIII Sec. IV).

Middle school, club and travel ball

Rule governs NDHSAA member-school activities only; nothing found reaching club/travel play. Handbook Part Four covers junior high; no NIL language found there.

Recent changes

None found (handbook July 2025 edition still carries the June 2022 interpretation)

The law

None (N.D.C.C. ch. 9-15.2 is the athlete-agent act, not an NIL law)

NCAA Division I, everywhere

Every deal worth $600 or more (added up per payer) entered since July 1, 2025 or the start of junior year, whichever is later, must be reported through NIL Go within 14 days of starting classes or before the first game.

Recruits enrolling on or after August 1, 2026 may hire agents under the April 15, 2026 Division I rule. The NJCAA still ends eligibility for a written agent agreement.

Quick answers

Can high school athletes in North Dakota make NIL money?

Yes. High school athletes in North Dakota can take NIL deals, with conditions. NDHSAA By-Laws Part II, Article VIII (Amateurism) carry a June 2022 interpretation: 'A student may benefit from the use of their name, image and likeness (NIL) consistent with current NDHSAA regulations.' Do North Dakota athletes have to tell the school about an NIL deal?

None statewide. No NIL-specific disclosure requirement found in the 2025-26 Constitution/By-Laws. (Article IX awards rule separately requires coaches to report award compensation to the AD within one month; that is an awards rule, not an NIL rule.)

Does a travel ball or club deal count in North Dakota?

State association rules follow the athlete, not where the deal came from. A deal through a travel team is fine as long as nothing ties back to the school team. Can a North Dakota high school athlete use an agent for NIL?
