Law in force

The law

ORS 702.200 and 702.205 (2025 Edition); 702.200 history: 2021 c.422 §1; 2024 c.15 §1; 2025 c.448 §1.

Disclosure

ORS 702.200(4)(b): athlete entering a compensated NIL/athletic-reputation contract must disclose it to a designated institutional official (team members directly; non-members when seeking to join the team); institution must identify any conflicting team rule or third-party contract; disclosed contracts are confidential.

Schools paying athletes

Allowed since 2025: ORS 702.200(2) (2025 c.448) 'A post-secondary institution of education may compensate a student athlete or prospective student athlete' for NIL/athletic reputation. (The pre-2025 text, still shown on oregon.public.law, prohibited it.) Compensation may not be conditioned on athletic performance but may be conditioned on attending a particular institution.

For high school recruits

'Prospective student athlete' may be compensated by an institution (702.200(2)), term undefined; no high-school language.

Recent changes

2025 c.448 §1 amended ORS 702.200 to permit institutional compensation of current and prospective athletes.

NCAA Division I, everywhere

Every deal worth $600 or more (added up per payer) entered since July 1, 2025 or the start of junior year, whichever is later, must be reported through NIL Go within 14 days of starting classes or before the first game.

Recruits enrolling on or after August 1, 2026 may hire agents under the April 15, 2026 Division I rule. The NJCAA still ends eligibility for a written agent agreement.

Quick answers

Can high school athletes in Oregon make NIL money?

Yes. High school athletes in Oregon can take NIL deals, with conditions. OSAA Handbook Rule 8.4.4 (under Rule 8.4 Awards/amateur status), approved Oct. 10, 2022: a student may earn NIL compensation if it is not contingent on athletic performance, is not an inducement to attend or remain at a member school (undue influence), is not provided by the member school or its agent, and the student discloses any proposed agreement to the school.

Do Oregon athletes have to tell the school about an NIL deal?

Before signing, to the school, no set deadline. Student must disclose any proposed NIL agreement/contract to the member school; no deadline, dollar threshold, or form specified.

Does a travel ball or club deal count in Oregon?

State association rules follow the athlete, not where the deal came from. A deal through a travel team is fine as long as nothing ties back to the school team. OSAA governs member high schools only; nothing reaches club play or middle school.
